Terms and Conditions (for parents and guardians)
- This agreement is between The Fees Company Ltd (TFC) and the parent/guardian named.
- The Fees Company Ltd agrees to give the parent/guardian credit for the termly fees and other amounts as agreed by The Fees Company Ltd as due to the school from time to time.
- The school is not an agent of The Fees Company Ltd. TFC is not responsible for any acts or omissions of the school. TFC makes no representations or warranties, express or implied in relation to the school or to any service provided by the school.
- The parent/guardian shall pay the Total Sum Payable to TFC in accordance with the Payment Details section overleaf by four equal monthly instalments. “the Repayments” commencing on the date specified overleaf of such other date as may be approved by TFC. Each of the monthly payments shall be payable by the parent/guardian by Direct Debit.
- TFC shall transfer directly to the school (named) a sum equivalent to the Amount of the School Fees upon cleared payment from the parent/guardian to TFC of any repayments due and payable at the time of transfer.
- The current rate of service charge is 1% of the term's fees subject to a minimum charge of £35. Any change in the service charge or administration fee or Amount Payable Monthly will be notified to the parent/guardian prior to collection by Direct Debit.
- If the parent/guardian fails to make any monthly payment within 7 days of its due date or fails to maintain a Direct Debit mandate or fails to comply with any of its due date or fails to maintain a Direct Debit mandate or fails to comply with any of the terms of the agreement, then and in any such event.
- the parent/guardian shall be in breach of the agreement
- the whole of the outstanding balance or Total Sum Payable will immediately become due and payable, and
- TFC shall be entitled to charge the parent/guardian an administration fee of up to £25 to TFC for each and every payment due under this Agreement from the parent/guardian to TFC which is not paid on the due date for payment
- from the date on which the event of default occurred TFC shall be entitled to terminate this Agreement and advise the school accordingly.
- If the parent/guardian is in breach as described in clause 7, the school shall be entitled to deal with such default in accordance with their existing contract with the parent/guardian and their policy with regard to the non-payment of fees.
- No failure or delay in exercising any rights or remedy of TFC shall affect TFCs rights under this Agreement or amount to a waiver of any breach by the parent/guardian or oof any such rights and remedies as TFC may have.
- TFC may at any time assign all or part of its rights or duties under this Agreement and in such event will give the parent/guardian no less than 30 days notice in writing of this.
- The terms of this Agreement unless otherwise advised by TFC will apply to any renewal contract on or before the date of such renewal contract.
- This Agreement shall be governed by and construed in accordance with the law of Scotland, England and Wale or Northern Ireland as appropriate.
