Terms and Conditions (for members)

  1. This Agreement is between THE FEES COMPANY LIMITED (TFC) and the member named overleaf.
  2. The Fees Company Limited agrees to give the Member credit for Golf Club fees and other amounts as agreed by The Fees Company Limited as due to the Golf Club from time to time.
  3. Members must be 18 years of age and over at the time of signing an application.
  4. The Golf Club is not an agent of TFC.  TFC is not responsible for any acts or omissions of the Golf Club.  TFC makes no representations or warranties whether express or implied in relation to the Golf Club or to any services provided by the Golf Club.
  5. The member shall pay the Total Sum Payable to TFC in accordance with the Payment Details section overleaf, with the first instalment (“First Payment”) being due on the Commencement Date of the Current Renewal Year (as specified overleaf) or such other date as may be approved by TFC.  Each of the monthly payments shall be payable by the member to TFC by Direct Debit mandate.
  6. TFC shall pay directly to the Golf Club (named overleaf) a sum equivalent to the Amount of the Golf Fees upon cleared payment from the member to TFC of the First Payment.
  7. If the member fails to make any monthly payment within 7 days of its due date or fails to maintain a Direct Debit mandate:
    1. The member shall be in breach of this Agreement;
    2. TFC shall be relieved from any liability to the member under this Agreement
    3. TFC shall be entitled to charge the member an administration fee of up to £25 to TFC for each and every payment due under this agreement which is not paid on the due date for payment.
    4. Membership of the club may be suspended with effect from the date when the breach occurred
  8. If the member is in breach as described in clause (7), the member shall be responsible for paying to the Golf Club the unpaid balance of the Total Sum Payable; and
    1. TFC shall be entitled to serve notice of such default on the Golf Club setting out in such notice the unpaid balance of the Total Sum Payable by the member to TFC at the date of such notice.
  9. No failure or delay in exercising any rights or remedy of TFC shall affect TFC’s rights under this Agreement or amount to a waiver of any breach by the member or of any such rights and remedies as TFC may have.
  10. TFC may at any time assign all or part of its rights or its rights or duties under this Agreement and in such event will give the member no less than 30 days notice in writing of this.
    1. The member shall not be entitled to assign this Agreement.
    2. In the event of renewal of this Agreement TFC may increase the monthly payment to reflect any change in the fees notified by the Golf Club to TFC.  TFC may also increase the service charge or administration fee.
    3. TFC will give the member 10 days written notice of any change in the monthly payment, the number of payments, the service charge or the administration fee.
